Terms and conditions
Effective as of 04/11/2026.
1. Service provider
Sébastien Hogrel, sole proprietorship (Entrepreneur individuel, EI), trading under the name Azuriva VTC, 744 chemin de Liecabre, 83510 Lorgues, France, SIRET 500 902 804 00037, VAT (TVA) FR41500902804. Contact: 07 86 80 59 09, seb@azuriva-vtc.fr.
2. Purpose
These terms apply to chauffeur-driven passenger transport services (VTC, private hire vehicle) booked with Azuriva VTC via the website, by phone, on WhatsApp or by email. Any confirmed booking constitutes acceptance of these terms.
3. Advance booking
In accordance with the Code des transports (French Transport Code), every VTC ride is carried out on prior booking: the chauffeur may not pick up a customer without a booking. A request sent from the website is not binding on either party: the booking becomes firm upon receipt of the chauffeur's written confirmation (email, SMS or WhatsApp), which summarises the journey, date, time and price.
4. Prices
Prices are expressed in euros including all taxes. The estimate shown online is calculated from the route, the time and the estimated tolls according to the following scale: pick-up fee €10, €1.50 per kilometre in the Alpes-Maritimes (06), €2.50 per kilometre in the Var (83) and €1.80 per kilometre in Fréjus and Saint-Raphaël, each kilometre being charged at the rate of the zone in which it is driven (outside these zones, the rate of the last zone crossed), minimum €50 excluding tolls, surcharge of 20% between 21h and 7h and of 20% on Sundays and public holidays (not cumulative). “From” prices correspond to a one-way trip on a weekday during the day.
The total price of the ride is communicated and accepted at the time of confirmation. It may only be changed if the customer requests a change (additional stop, change of address, waiting beyond the agreed time, extra luggage or passengers), in which case the additional amount is announced before being applied. Weddings, tours and hourly chauffeur hire are subject to a quote.
5. Payment
The method and timing of payment (on board, by bank transfer or via a payment link) are specified in the confirmation. An invoice is provided on request.
6. Cancellation and changes
The customer may cancel or change their booking free of charge up to 24 hours before the pick-up time, by phone, WhatsApp or email. After this deadline, or if the customer is not present at the pick-up point, the full fare may be charged. For services provided on a quote basis, the cancellation terms stated in the quote apply.
The right of withdrawal provided for distance contracts does not apply to passenger transport services (article L221-2 of the Code de la consommation, French Consumer Code).
7. Waiting time and delays
For an airport or station transfer, the pick-up time is adjusted to the actual arrival of the flight or train whose number has been provided. For other pick-ups, a reasonable waiting time is included; beyond that, waiting may be charged at the rate stated in the confirmation.
8. Client obligations
The customer states the exact number of passengers and pieces of luggage as well as the presence of children (suitable seat on request). Seat belts are compulsory for all passengers. Smoking and the consumption of alcohol or illegal substances on board are prohibited. The chauffeur may refuse or stop a ride in the event of behaviour that endangers safety. Any damage to the vehicle is chargeable to the person responsible.
9. Provider obligations and liability
The chauffeur holds the professional VTC driver's card and the vehicle is covered by civil liability insurance suited to the paid transport of passengers. The provider makes every effort to keep to the agreed times but cannot be held liable for a delay caused by force majeure (exceptional traffic conditions, bad weather, road closure, accident). Items left on board are kept and held at the customer's disposal.
10. Complaints and mediation
Any complaint should be sent to seb@azuriva-vtc.fr. In accordance with articles L611-1 et seq. of the Code de la consommation (French Consumer Code), consumer clients may refer the matter free of charge to a consumer mediator within one year of their written complaint. Mediator's contact details: provided on request.
11. Personal data
The data provided when booking is processed in accordance with the privacy policy.
12. Governing law
These terms are governed by French law. Failing an amicable resolution, any dispute falls under the jurisdiction of the competent courts in accordance with ordinary legal rules.
